I've recently picked up with the idea of building a broad computer security information website (covering anti virus programs, identity theft, firewall software, software reviews and comparison, etc). What worries me is a registered trademark for 'securify'. Before I put time and energy in developing the website I would like to know if I'm allowed to use the name in this fashion.

The trademark has the following description:.


Goods and Services IC 009. US 021 023 026 036 038. G & S: Computer software used to detect and respond to threats to computer network security; computer software used to manage, maintain and monitor computer network security, computer network management and computer network maintenance; computer software used to develop and analyze policies used for computer network security, management and maintenance and user manuals provided in connection therewith. FIRST USE: 20000600. FIRST USE IN COMMERCE: 20000600.

I'd appreciate your (educated) opinions...

My personal opinion is no, you can not use the name for that use...

McAfee has acquired Secure Computing which had already acquired Securify Inc.

I think it could be argued hat the TM only covers computer network security. If you avoid that use, then I think it would be usable...

That was also my initial thought but IANAL... the site I want to make is closely related to what the TM covers. Better to be safe than sorry ;-)..

That's a made up word (i.e. fanciful mark - the strongest kind of tm) - using that the way you mentioned is asking for trouble. IMO - IANAL either..

Not worth the hassle. Grace delete IMO if you have that option. If not, don't park it or list it for sale as that could be considered bad faith.

A similar thing happened to me recently. I thought I'd found the perfect name but declined after finding a TM including the fanciful word and for similar business...

If you can't get a refund for the reg fee you can always send an email to give back the domain for free to the company and add a PS "but I am going to use it for my site etc, would it be possible for me to use it for etc".

Of course IANAL too..
