Hey guys,.

I hardly ever ask any legal questions as I always try to stay as far away as possible from any domain name issues, but now I have one.

I have a site that I would like to make, but the domain name, lets say Car/img/avatar7.jpg.Com is taken, and a landing page has been put up stating that a forum is coming soon (doing what I wanted to do) - But it has been that way for 3 months now.

I want to get the domain name Car-/img/avatar7.jpg.Com (the hyphen ties in with other sites I have) and build a forum.

There are no TM issues with either domain names - But does Car/img/avatar7.jpg.Com /img/avatar7.jpg have any claim to Car-/img/avatar7.jpg.Com, and/or any related content that I put up? As I say, at the moment the Car/img/avatar7.jpg.Com site is still a landing page (3 months like that).

Well, I am not a lawyer, but it sure seems like a generic descriptive term to me.

No, they have no claim as far as I know in my capacity as a non-lawyer.

You cannot simply grab a store front and hold it empty for years and expect everyone around you not to simply build the same.

But if ever they simply wish to shove a parking page up to take advantage of people looking for you then they will, it would be something like a street with a row of shops, they have the first shop so get all the benefit of your advertising. And you go out of business because no one ever comes. probably should maybe look for alternative names or be prepared to make an offer...

I have searched, the name I am talking about is directly relevant to the area for which I want the site to go in to - I will use the hyphened version possible, I have attempted to obtain the name by purchasing it but the owner has yet to responde...

More related to online area, such as ( is closer to what I am talking about.

Is it a domain that corresponds to an existing offline business? If not, and they're not using it and there's no tm filing with intent to use, I can't think of any reason not to beat them to the punch.

They certainly won't have any claim to your original content...
