Can I register a name like this:.

Found an available name that used to be a site, was registered and used by a company but has been a coming soon page for about 7 years then available. the name is a general brandable term for a tool like "band saw" and the company's name was like "the band saw". assuming they are out of business, is this alright?.

I'm a little confused on searching for a TM.

I googled "thing trademark" with no results and looked at the PTO website with no exact results. but the second word is listed as a live TM but selling something totally different.

Can someone tell me how to look for my name in other extensions. it's easy to see if the .net and .org etc are taken but I have found one in a .cc and it says store with this name coming soon. I would like to know are we both allowed to use the name?.

Can I submit for a TM before forming a legit business?.

If I do get the TM can I enforce that on someone in germany when my company would be in the US?.

To look for a name in other extension, just visit namecheap and select all the extension and search the name.

Regarding TM submission, I dont know whether it is allowed or not.

You can try to enforce a TM law if they are affecting your business in any way...

Ok thank you that helped alot, I guess I needed to do more homework.

I see an extension taken with an active store and the owner (another country) also runs a sellers account on a popular site with this name. does their active use of the name already make it so I cannot file for TM?..

I once waited tooo long to register a name that was available. When I went back a few hours later it was gone! Go with you domain sense, Dont hesitate. I'd reg it if I were you...

I am quite agree with the "Go with you domain sense",something maybe you can't tell why,but what you feel is strangely right...
